Many Brits are buying holiday homes in Florida for rental and investment purposes, many wondering if buying a property can help them gain US resident status.

Anyone expecting a visa based on the purchase of a single home in the US will be sorely disappointed as they will never be able to justify the business investment reason.

However, a carefully presented visa application involving the purchase of 3 or more flats along with the submission of a comprehensive detailed business plan could be successful.

If the visa application is poorly presented or if the property is shown as a “passive investment”, it will usually be rejected. It is best for anyone considering applying to use an experienced professional with a proven track record to prepare such a business plan.

Only the purchase of real estate will always be considered a passive investment, but if the application clearly demonstrates an “active real estate business,” an E2 visa may be issued.

It is also imperative to demonstrate a “substantial financial investment” that was made prior to submitting the application, and although the actual amount is not actually stated anywhere, it cannot be less than $100,000.
